JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks anticipatory bail in a case registered for the offences punishable under Sections 341,342 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that civil suit for specific performance of contract is pending between the petitioner and father-in-law and the husband of the informant. This is the reason behind institution of the present case by the Informant. He has submitted that petitioner is nearly 70 years old and story as narrated by the Informant in the First Information Report on the face of it appears to be
Patna High Court Cr.Misc. No.7180 of 2015 (3) dt.02-07-2015 improbable, keeping in view the petitioner's old age. He has referred to the Identity Card issued by the Election Commission of India, wherein his year of birth is mentioned as 1948. In view of the submission as above, let above named petitioner in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Biraul at Benipur, Darbhanga in Kusheshwar Asthan P.S. Case No. 60 of 2013, G.R. No. 184 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
