JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-05-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Tandwa P.S. Case No. 03 of 2014 registered for the offence under Sections-341, 323, 325, 504/34 of the Indian Penal Code and under Sections-3-(x) of SC/ST (Prevention) of Atrocities Act. In my view, this anticipatory bail petition is not maintainable and accordingly, prayer for anticipatory bail of the petitioners in connection with Tandwa P.S. Case No. 03 of 2014 stands dismissed being not maintainable.
However, this order shall not cause any prejudice to the learned court below at the time of consideration of regular bail application of the petitioners.
