2. The petitioner has preferred this application for grant of regular bail in connection with Patahi P.S. Case No. 299 of 2024 dated 23.11.2024 registered for the offences punishable under Sections 105, 126(2), 115(2), 191(2), 191(3) and 190 of the B.N.S.

3. As per the prosecution case, the petitioner and the co-accused persons came to the house of the informant and brutally assaulted the informant, thereafter the petitioner and the co-accused Nitesh Sah pressed the neck of the informant with intention to kill him and when his mother came to rescue, they also assaulted the informant's mother, in the meantime, the co-

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. As per the post-mortem report of the deceased, the cause of death is chronic lung and heart disease. There is no specific allegation against the petitioner rather the specific allegation is against the co-accused, Nitesh Sah, who is said to have pushed the informant's mother. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 24.11.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Motihari, East Champaran in connection with Patahi P.S. Case No. 299 of 2024.

7. The application stands allowed.
