JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 This application, for grant of anticipatory bail, arises out of Jehanabad P.S. Case No. 981 of 2018, disclosing offences under Sections 419, 420, 467, 468, 471, 483/34 of the Indian Penal Code.
Allegation against the petitioner is of recovery of duplicate products of Tata Tea, A to Z syrup of Alcame Company and Nihar Oil of Morico Company and petitioner succeeded in fleeing away.
Submission of learned counsel for the petitioner is that as a matter of fact he was not present in the house and in his absence, it was kept by one Prakash only with a view to falsely implicate the petitioner, which will appear from the fact that the recovery has been made from Verandah, which is an open place and had there been any intention of the petitioner, he would

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Jehanabad, in connection with Jehanabad P.S. Case No. 981 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
