JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 458 and 380 of the Indian Penal Code.
It is alleged that the theft was committed in the house of the informant and subsequently the informant saw this petitioner fleeing away from the place of theft. It is submitted by the learned counsel for the petitioner that the petitioner is the neighbour of the informant and acquainted with the family members of the informant but he was not identified by the children of the informant who saw the theft being committed. It is further submitted that the informant was aggrieved with the petitioner because the petitioner's father refused to execute sale deed with regard to a land in favour of
Patna High Court Cr.Misc. No.8980 of 2015 (2) dt.04-03-2015 2/2 the informant. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 286 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Sujit/- U
