2. The petitioner apprehends his arrest in connection with Gogri P.S. Case No. 162 of 2023, registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.
3. The victim, in her statement recorded under Section 164 of the CrPC has stated that co-accused Prabhakar brought her on his motorcycle and the petitioner put vermilion on her head without her consent.
4. The learned counsel for the petitioner has submitted that a joint affidavit has been filed in the court below and from perusal of which, it would appear that the victim is aged about 21 years. It also appears from the affidavit that the victim has solemnized marriage with the petitioner with her own sweet will but when she came to her parents, she retracted from her statement made
Patna High Court CR. MISC. No.14489 of 2025(4) dt.14-10-2025 2/2 in the affidavit under the pressure of her parents.
5. On the other hand, learned APP for the State has opposed the prayer for bail.
6. Considering the above-mentioned facts and circumstances, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Gogri P.S. Case No. 162 of 2023, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
