It has been submitted that the petitioner has filed this writ application against the relief granted to the respondent to contest the suit. The petitioner's suit is under section 11 (1) (d) read with section 14 of Bihar Buildings Control Act. By this time almost four years have already passed over. The evidence is going on and so at this stage the petitioner does not want to press this application.

In view of submission of learned counsel for the petitioner, this application is dismissed as withdrawn. However the Court below is required to expedite the trial in view of provision of Bihar Buildings Control Act on priority basis. (Sanjay Kumar, J) Mahesh/- U
