The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406 and 420/34 of the Indian Penal Code.

It is alleged that the petitioners were paid Rs. 8,00,000/- on promise to provide employment in Coal India Ltd.

It is submitted by learned counsel for the petitioners that there is no proof with regard to payment since the petitioner no. 1 has also filed a complaint case against the informant with similar accusation and in fact, the daughter-in-law of the informant is an employee of Coal India Ltd.

Moreover, the case has been lodged with an

It is submitted by learned counsel for the informant that the case lodged by petitioner no. 1 is subsequent in time.

Considering the nature of accusation and a statement made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Dumraon P.S. Case No. 11 of 2015 on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M. Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
