This is an application for bail in connection with Motihari Town P.S.Case No. 280 of 2012, corresponding to Trial No. 2255 of 2016, registered for the offences punishable under Section 387 of the Indian Penal Code.

Allegation against the petitioner is for demanding extortion from the informant.

It has been submitted on behalf of the petitioner that the Mobile number, which has been shown, does not belong to the petitioner and at that time he was in custody and, as such, he has falsely been implicated in this case and he has been remanded in this case on 11.9.2012.

Heard learned APP also.

No.18064 of 2017 (2) dt.19-04-2017 2/2 Having heard both sides and considering the nature of allegation and also considering the fact that petitioner has been made accused in 25 other cases of similar type, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected. However, as the petitioner is in custody, learned trial court is directed to expedite the trial of the petitioner on day-today basis and at the same time Superintendent of Police, East Champaran is directed to ensure the presence of the witnesses in court on the date fixed, so that the trial may be concluded at the earliest.
