The petitioner apprehends her arrest in Gandhi Maidan P.S. Case No. 116 of 2014, registered for the offences punishable under Section 498A and other Sections of the Indian Penal Code and Sections 3(x)(xii) of the SC/ST Act.
The informant made allegation that she was in love with Sanjeev Kumar and she became pregnant. The marriage of the petitioner was solemnized with Sanjeev Kumar, but the accused persons called her in India Hotel, Exhibition Road, Patna and Sanjeev Kumar put vermillion on her head. It is alleged that the petitioner and others assaulted her and drove her out from the house. Learned counsel for the petitioner submits that the petitioner is mother-in-law of the informant. All the allegations are false and
Patna High Court Cr.Misc. No.8904 of 2015 (2) dt.04-03-2015 2/2 concocted.
On the other hand, learned counsel for the informant vehemently opposed the prayer for anticipatory bail and submitted that it was the petitioner who instigated her son not to keep the informant. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the informant was in love with the son of the petitioner and they are said to have solemnized marriage and the petitioner was nowhere in between her son and the informant, the petitioner, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Gandhi Maidan P.S. Case No. 116 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
