1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Baruraj P.S. Case no. 64 of 2022, registered under sections 307, 379, 341, 323, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, three accused persons including the petitioner herein are said to have assaulted the informant and of having taken away Rs.70,000/-.

4. Learned counsel for the petitioner submits that so far as the assault with the butt of a pistol on the head of the informant is concerned, it is specific on Shivam Kumar. Coaccused Abhishek Kumar has been enlarged on bail vide order dated 24.2.2023 passed in Cr. Misc. no. 64534 of 2022. He is in

Patna High Court CR. MISC. No.14655 of 2024(2) dt.14-03-2024 2/2 custody since and charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR, his being in custody for more than 3 months since 16.11.2023 and grant of bail to similarly situated co-accused Abhishek Kumar vide aforesaid order dated 24.2.2023, the petitioner is directed to be enlarged on bail in connection with Baruraj P.S. Case no. 64 of 2022, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur.
