2. The petitioner apprehends his arrest in connection with Benipatti P.S. Case No.186 of 2021 instituted under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.
3. The petitioner and other accused persons are alleged to have abused and assaulted the informant. One co-accused Rohit Kumar is alleged to have assaulted with knife and took away money from the pocket of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that the co-accused Rohit Kumar has already been granted anticipatory bail by learned 1st Additional
Patna High Court CR. MISC. No.15788 of 2024(2) dt.13-03-2024 2/2 Sessions Judge, Madhubani in A.B.A. No.1410 of 2021 on 07.01.2022. The petitioner has no criminal antecedent and there is no material against the petitioner.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Madhubani in connection with Benipatti P.S. Case No.186 of 2021, subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
