====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with GRP/ Jhajha (Rail) P.S. Case No. 18 of 2017, registered under Sections 30(A) and 38(1) of the Bihar Excise (Amendment) Act, 2016. The accusation is of recovery of 140 pouches, each containing 200 ml, of illicit country made liquor beneath the seat from the boggy of Tata Nagar-Danapur Train, of which, petitioners were found sitting.

Learned counsel for the petitioner submits that petitioners have falsely been implicates in this case mere on suspicion. It is further submitted that petitioners have no criminal

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway, Kiul at Lakhisarai, in connection with GRP/ Jhajha (Rail) P.S. Case No. 18 of 2017. Out of two sureties, one surety must be the close relative of the petitioners.
