JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-02-2016 Petitioners being elder brothers and their wives of the husband of the complainant are apprehending their arrest in a complaint case wherein processes were directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 406, 323 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by learned counsel for the petitioners that only summons have been issued against the petitioner.

In view of the ratio laid down in the case of Salim Ansare @ Md. Salim Ansare and Others Vs. The State

Patna High Court Cr.Misc. No.5305 of 2016 (2) dt.22-02-2016 2/2 of Bihar & Another reported in 2015(3) PLJR, 806(Cr. Misc. No. 51075 of 2014), let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Complaint Case No. 187 of 2015, pending in the Court of learned Sub-Divisional Judicial Magistrate, Daudnagar. With the observations above, the application stands disposed off.
