The petitioner, who is in custody, seeks bail in connection with Begusarai Town P.S.Case No. 195 of 2016 registered under Sections 399 and 402 of the Indian penal Code, Section 25(1-b)a, 26 and 35 of the Arms Act and Sections 53(B) and 54 of the Bihar Excise (Amendment) Act, 2016. Allegation in brief is that the police apprehended some miscreants, while they were assembled at one place, and recovered one country made pistol with four cartridges and a motor cycle from this petitioner and also recovered fire arms from other co-accused persons.
Submission is that other co-accused persons, who were apprehended with loaded fire arms, have been admitted to
Patna High Court Cr.Misc. No.3704 of 2017 (5) dt.01-03-2017 2/2 bail by a co-ordinate Bench of this Court by order dated 24.11.2016 and 23.12.2016 passed in Cr. Misc. No. 50685 of 2016 and Cr. Misc. No. 54633 of 2016 respectively and this petitioner has got 08 criminal antecedents but in all cases, he is on bail. Having considered the fact that the case of the petitioner stands on similar footing than two other co-accused who have been granted bail by a co-ordinate Bench of this Court, so considering the fact and circumstances, the petitioner, namely Rupesh Kumar @ Bideshiya is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S.Case No. 195 of 2016.
