The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30(a) and 32 of the Bihar Prohibition and Excise Act, 2018 and Sections 2 (e), 3, 5(b), 18 of the Bihar Mahua Flower Act. Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather about 5 litres of Mahua liquor has been recovered from the Jhopri. He submits that the said Jhopri is not belonged to the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail petition. However, petitioner is agreed to deposit Rs. 5,000/- in
Patna High Court CR. MISC. No.9134 of 2020(2) dt.28-02-2020 2/2 the Juvenile Justice Fund of the State Social Welfare Department.
In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Laraiya Tand Police Station Case No. 47 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
