The petitioner seeks regular bail in connection with Pothia P.S. Case No. 52 of 2017 for the offences punishable under Sections 147, 148, 149, 447, 323, 504, 506 and 384 of the Indian Penal Code.
The allegation against the petitioners and others is that they entered into the Daffari Tea State Pvt. Ltd. and plucked the tea leaves weighting about four thousand Kg.
It is submitted by the learned counsel for the petitioner that the petitioner had already been granted bail by the learned court below on 2.6.2017, however, his bail bond was cancelled on account of concealing the factum of having filed anticipatory bail petition un- successfuly, which the learned counsel submits
Patna High Court Cr.Misc. No.10607 of 2019(2) dt.25-02-2019 2/2 was an unintentional mistake. It is further submitted that the petitioner is languishing in custody since 27.06.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 52 of 2017.
