JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-12-2022 The present writ petition has been filed seeking the following reliefs:- "1(i). For the protection of life of the petitioner, who have entered into the marriage under Special Marriage Act being a Major of more than 21 years with his wife Iffat Faizy Soni (Respondent No.9) on the Mursybul offer of his wife a working girl under IIFL (India Infoline Ltd.) Ashiyana

(ii). For a direction/ directions/ order/orders to the respondent State authorities to help the petitioner who has been ruined by his life and wealth due to offered live-in-relationship by the Respondent No.9 being major couple and willingly entered into the marriage contract bond and compelled by their surrounding people to come back from the marriage bond after a loss of wealth."

At the outset, the learned counsel for the Respondent-State has submitted, by referring to the counter affidavit filed in the present case that the petitioner has never approached the police authorities for any sort of protection of his life, however, on the contrary, the private respondent no.9, whom the petitioner claims to be his wife, has filed a counter affidavit, wherein it has been stated that the marriage in question has never

Patna High Court CWJC No.2839 of 2015(2) dt.06-12-2022 3/3 taken place and in fact the petitioner is not only harassing her, but is also circulating her obscene pictures, which are forged and morphed, on the social media.

It appears that on account of the stand taken by the private respondent no. 9 in her counter affidavit and the stand taken by the RespondentState in the counter affidavit filed in the present case, the petitioner has abandoned this case, inasmuch as nobody has turned up to prosecute the present writ petition. Thus, this Court has no option but to dismiss the present writ petition, being devoid of any merit.

Accordingly, the present writ petition stands dismissed.
