The petitioners are in custody in connection with Sahebganj P.S. Case No. 483 of 2018 for the offences under Sections 392 and 402 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.

Learned counsel for the petitioners submits that petitioner no.1 has one criminal antecedent whereas petitioner no.2 has no criminal antecedent and they are in custody since 27.12.2018. He further submits that petitioners were apprehended by the police on the suspicion that they were preparing for commission of serious offence. Petitioner no.1 was accused in Kanti P.S. Case No. 500 of 2018 but petitioner

Patna High Court Cr.Misc. No.10476 of 2019(2) dt.21-02-2019 2/2 was not named in the F.I.R. in Kanti P.S. Case No. 500 of 2018. Considering the aforesaid, the Court is inclined to grant bail to the petitioner, let the petitioner named above be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned 1st Additional Chief Judicial Magistrate West, Muzaffarpur in connection with Sahebganj P.S. Case No. 483 of 2018.
