JUSTICE BIRENDRA KUMAR ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody in connection with Shambhuganj P.S. Case No. 165 of 2016 for the offences punishable under Sections 147/148/149/302/506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation is that the petitioner caught to the deceased and other co-accused fired causing death of the brother of the informant, who is an eyewitness of the occurrence. Learned counsel for the petitioner submits that the allegation appears to be improbable because the person, who was holding the victim, might have sustained fire-arm injury.
