JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Complaint Case No. C.C.121/2015, disclosing offences under Section 47(a) of the Excise Act.

According to the prosecution case, 19 cartoons containing 456 bottles of country made liquor was recovered from a shop, whose composite licence issued for sale of country made liquor was cancelled. The petitioner has been made accused on the ground that he was the Manager of the said shop. Learned counsel for the petitioner submits that the petitioner is in no way connected with the said shop and the

Patna High Court Cr.Misc. No.6167 of 2016 (2) dt.24-02-2016 licence was issued in favour of co-accused Bipin Kumar Sah. He has also submitted that the petitioner has no criminal antecedent. Considering the aforesaid submissions, this application is allowed.

Let the above-named petitioner in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in Complaint Case No. C.C. 121 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
