The petitioners seek bail in connection with Suppi P.S. Case No. 266/2021 lodged under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation made in the FIR, the total 157.500 liters of Nepali Saufi wine alleged to be recovered from western bank of the river.

He further submits that FIR has been lodged on 05.12.2021 whereas alleged arrested was made on 04.01.2022 by which it transpires that no recovery made from the conscious possession of the petitioners. He further submits that charge sheet has already been submitted in the case, the petitioners are in custody since 04.01.2022 and having no criminal antecedent.

The learned A.P.P. for the State opposes the prayer for bail.

In the facts and circumstances of the case that charge sheet has already been submitted, petitioners are in judicial custody 04.01.2022, no recovery from the conscious possession of the petitioners and having clean antecedent, let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court No.1, Sitamarhi, in connection with Suppi P.S.
