The petitioner seeks bail in Salaiya P.S. Case No. 31/2016, registered for the offences punishable under Sections 386, 120(B), 124(a) of the Indian Penal Code and section 17 of the C.L.A. Act.

The S.H.O. Salaiya alleged that petitioner joined M.C.C. and he had talk with Ram Pravesh Yadav from his mobile. It is alleged that petitioner was providing place to sit the M.C.C. and also giving information about the arrival of the police. The petitioner used to collect levy for M.C.C.

Learned counsel for the petitioner submits that Ram Pravesh Yadav is co-villager, but the petitioner is not accused in

Patna High Court Cr.Misc. No.10973 of 2017 (3) dt.04-04-2017 any other case. There is no material to show that the petitioner ever collected any levy from any person for M.C.C. The petitioner is in jail since 07.11.2016.

Considering the facts aforesaid and the fact that the petitioner has got no criminal antecedent, as stated in para 3 of the bail petition, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Salaiya P.S. Case No. 31/2016.
