2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 406, 420 and 34 of the Indian Penal Code.

3. As per prosecution case, it is alleged that on the persuasion of co-accused Satendra Mahto, informant gave Rs. 10,78,000/- to this petitioner who, after receiving the alleged money, did not refund the same to the informant.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. From bare perusal of the F.I.R. it is apparent that nature of dispute is civil in nature. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he took Rs. 10,78,000/- from the informant but did not return the same.

6. Considering the specific and direct nature of accusation, the prayer for grant of anticipatory bail to the petitioner is rejected.
