The petitioners being the parents of the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 504 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Basic accusation is of torture for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioners that accusation is omnibus and general and the thrust of accusation is against the husband of the complainant. The

No.7474 of 2016 (2) dt.15-02-2016 2/2 petitioners claim to be separate from the husband of the complainant and the husband of the complainant is ready to keep the complainant as wife with full dignity and honour. A statement to that effect has been made in paragraph 10 of the petition, which reads as follows :- "10. ....... the husband is still ready to keep the complainant with full respect...."

Considering the thrust of accusation against the husband of the complainant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Saharsa in connection with Complaint Case No.1913 C/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
