The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 435, 384, 427, 506 of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act. The allegation against the accused persons is of setting the motorcycle of the informant on fire.
Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with an observation "at this state".
A report was called for from the trial court regarding the stage of the case. It has been reported that the case is awaiting for the compliance of Section 207 of the Cr.P.C.
Patna High Court Cr.Misc. No.11655 of 2017 (3) dt.29-03-2017 2/2 It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.10.2015. He is not named in the F.I.R. There is no substantive evidence to suggest his implication in the present case. Merely one the basis of secret information, received by the police, he has been made accused in the present case.
On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Sherghati at Gaya in connection with Kothi P.S.
