This application for anticipatory bail arises out of Ashthawan P.S. Case No. 97 of 2020, for the offence punishable under Sections 341, 323, 325, 307, 504, 506 read with section 34 of the Indian Penal Code.

In view of the fact that the parties are own brother and there has been compromise between the parties, learned counsel for the petitioners seek leave to withdraw the present anticipatory bail application on behalf of the petitioners no. 1 & 4. They would surrender in the Court below within aforesaid time. Permission is granted.

Considering the above submission, this application is allowed. Let the petitioners no. 2 & 3 above named, in the event of his arrest/ surrender within six weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Ashthawan P.S. Case No. 97 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
