The petitioner apprehends his arrest in Complaint Case No.2585 of 2017 registered under Sections 406 and 467 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the petitioner is only an agent of Tata AIA Insurance Company. The policy term of the complainant was for 10 years and after depositing only three annual premium, the complainant did not continue the same. The company after five years issued a payout cheque but the complainant did not encash. Thereafter, another cheque was issued to the
Patna High Court CR. MISC. No.22047 of 2021(8) dt.12-05-2022 2/2 complainant but again the complainant did not encash the same as is evident from Annexure 1 series to the supplementary affidavit.
Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Vaishali at Hajipur in connection with Complaint Case No.2585 of 2017 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
