The petitioner seeks regular bail in connection with Nokha P.S. Case No. 300 of 2018 for the offences punishable under Sections 341, 326(k) and 427 of the Indian Penal Code. The allegation is regarding acid having been thrown by the co-accused person, namely, Kanhaiya Chaudhary on the daughter of the informant and the petitioner was stated to be standing nearby.
The learned counsel for the petitioner has submitted that admittedly no role has been attributed to the petitioner herein and in fact, the main culprit is co-accused Kanhaiya Chaudhary who should be dealt with strictly. It is stated that though the petitioner is accused in one case, but he is on bail in
Patna High Court CR. MISC. No.12861 of 2019(2) dt.01-03-2019 2/2 the said case. It is further submitted that the petitioner is languishing in custody since 25.11.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram, Rohtas in connection with Nokha P.S.
