2. The petitioner has preferred this application for grant of regular bail in connection with Dharhara P.S. Case No. 133 of 2024 dated 25.05.2024 registered for the offences punishable u/ss 447, 341, 323, 327, 325, 307, 504 and 506 read with Section 34 of the Indian Penal Code.

As per the prosecution case, the petitioner and the co-accused persons are alleged to have come to the field of the informant and started to plough his field and his brother Birendra Kumar objected for the same upon which they abused and assaulted him on his head by katta on the front and back side of his head causing injury on his head and broke his right

Patna High Court CR. MISC. No.12253 of 2025(2) dt.24-03-2025 2/3 thumb and also threatened to kill him. When the informant came to his field, he was also assaulted by the accused persons and he fell unconscious. The informant and his brother were taken to the hospital for treatment.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that the informant, Ashish Kumar sustained simple injury though the informant's brother Birendra Kumar sustained three grievous injuries but there is no specific allegation against the petitioner that he has caused any of the said grievous injuries. The petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 26.11.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the anticipatory bail petition of the petitioner was earlier rejected by a Coordinate Bench of this court vide order dated 05.10.2024 passed in Cr. Misc. No. 63264 of 2024.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.12253 of 2025(2) dt.24-03-2025 3/3 of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Munger in connection with Dharhara P.S. Case No. 133 of 2024.

7. The application stands allowed.
