JUSTICE SANJAY KUMAR ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner and learned APP appearing on behalf of the State.
The petitioner seeks regular bail in connection with Ramkrishna Nagar P.S. Case No. 208 of 2016 registered for the offences punishable under Sections 120(B) of the Indian Penal Code and Sections 30(A), 38, 41, 47 of the Bihar Excise and Prohibition Act, 2016.
On secret information, the police conducted raid in a godown belonging to Nirhul Kumar and seized a huge quantity of liquor kept in godown. This petitioner was allegedly standing outside the said godown and was arrested by the police on suspicion. The petitioner claims to be a tempo driver and his tempo was parked outside the godown.
Patna High Court Cr.Misc. No.5875 of 2017 (2) dt.15-02-2017 2/2 Learned counsel for the petitioner submits that nothing has been recovered from his tempo. He has been arrested merely on suspicion and he is in custody for about four months.
Learned APP for the State opposed the submission. Considering the period of custody of the petitioner as well as facts and circumstances stated above, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Ramkrishna Nagar P.S.
