JUSTICE ANIL KUMAR SINHA ORAL ORDER 30-09-2022 Learned counsel for the petitioner submits that the subject matter of the land involved in the probate case and the Will is the property of the petitioner and the testator. The testator has no title to execute the Will pertaining to the said land.

After some argument, learned counsel for the petitioner seeks permission to withdraw this application with liberty to file a Title Suit claiming his title upon the land before the competent court.

Permission is granted.
