In this case, the petitioner is seeking regular bail in connection with Kudhani P.S. Case No. 668 of 2019 registered for offence punishable under sections 414, 467, 468, 471/34 of the Indian Penal Code and under sections 30 (a), 38 (i) and 41 (i) of the Bihar Prohibition and Excise Act. On the basis of secret information, a raid was conducted and the police recovered 2538.00 liters of illicit foreign liquor from a truck and four persons including this petitioner has been arrested.

Patna High Court CR. MISC. No.11034 of 2020(3) dt.13-05-2020 2/2 accused Chandan Kumar Shahi has been granted regular bail by this Court in Cr. Misc. No. 85596 of 2019. He further submits that the petitioner is in custody since 14.10.2019. Considering the aforesaid facts, the petitioner, named above, is directed to be released on bail on his personal bond to the satisfaction of Special Judge, Excise Act, Muzaffarpur, in connection with Kudhani P.S. Case No. 668 of 2019, subject to the condition that if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to file an application for cancellation of his bail bond.
