The petitioner apprehends his arrest in connection with Khanpur P.S. Case No. 154 of 2018 for the offence punishable under Sections 47, 3(a), 41(1) and 41(2) of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner rather the alleged recovery has been made from the cattle shed which is evident from the seizure list. Considering the facts and circumstances of the case, let the, above named, petitioner in the event of surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act -cum- A.D.J.-3rd, Samastipur in connection with Khanpur P.S. Case No. 154 of 2018 subject to the conditions laid down under Section 438(2) of the Cr.P.C.
