The petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of the dowry demand. The petitioner and the informant are present.
It is submitted by learned counsel for the petitioner is not ready to reconcile the issue since the informant
Patna High Court Cr.Misc. No.5928 of 2015 (07) dt.18-08-2015 2/2 eloped with Nirmal Paswan, the brother-in-law of the informant. The counsel for the informant denies the contention of learned counsel for the petitioner and submits that she is ready to resume the conjugal life.
Considering the fact that the marriage between the petitioner and the informant is admitted and the present stand of the petitioner, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Shahpur P.S. Case No. 276 of 2014 pending in the court of learned Chief Judicial Magistrate, Bhojpur at Ara.
With the aforesaid observation, this application is disposed of.
