JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 285, 304, 337 and 338 of the Indian Penal Code.
It is alleged that on 20.11.2011, an explosion took place in the damaged wagon which is alleged to have been purchased by Vinit Kumar Arya. During explosion four persons received injury and out of them one person succumbed to the injuries. It is submitted by learned counsel for the petitioner that the petitioner was not named in the FIR, his name subsequently sprang up during investigation. The petitioner is the engineer in the Railway posted at Siliguri who was supposed only to give technical status report relating the railway article. Considering the fact that the explosion took place while cutting the damaged wagon of railway and the same was auctioned properly in favour of Vinit Kumar Arya, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kishanganj in connection with Pothiya P.S. Case No. 130 of 2011, subject to the conditions as laid down under Section 438(2) Cr.P.C.
