JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 25-08-2015 The instant writ petition has been filed for issuance of a direction to the respondents for proper investigation of Hasanpur P.S. Case No. 29 of 2014 and to take appropriate steps for recovery of minor son of the petitioner. It is contended that the investigation of the case is not being conducted in a proper manner. Though the first information report was registered on 03.04.2014 for an offence under sections 363, 364(A) of the Indian Penal Code, the Investigating Agency has failed to recover the victim of the crime.

WJC No.132 of 2015 (2) dt.25-08-2015 2/3 the State in which it has been contended that in course of investigation it transpired that ransom call by mobile number on different dates were made to the informant's mobile. Those facts were also brought to the notice of the police by the informant of the case. Accordingly, the police took proper action to nab the callers who were making ransom demand from the informant. The numbers were put on track and five persons were arrested during investigation. They have been interrogated and remanded to judicial custody in the present case but unfortunately the police could not find the whereabouts of the victim. Though charge sheet has been submitted against the accused persons who have been remanded in the case, investigation is still going on.

It is contended on behalf of the State that all possible steps would be taken by the police to recover the victim of the crime. Regard being had to the facts and circumstances of the case, the application is disposed of with a direction to the Superintendent of Police, Samastipur to personally look into the matter and supervise the further investigation of the case. It is needless to say that all possible efforts should be made by the police to recover the victim. It is expected that Investigating Agency would bring the investigation of the case to its logical end within a reasonable time.
