The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 427, 341, 323, 324, 307, 379, 354 and 504 of the Indian Penal Code and Section 3(i) (x) (xi) of SC/ST Act. Prosecution case is that accused persons came over the land of informant and started throwing fire wood of informant and on protest being made on the order of co-accused Braj Bhushan Singh @ Bhola Singh, Bangtu Singh caused injury with
Patna High Court Cr.Misc. No.6473 of 2016 (2) dt.11-02-2016 2/2 pharsa on the head of informant. When the informant's father Dukha Ram and wife Pawan devi and others came to rescue they were also assaulted. It is further alleged that the accused persons including the petitioners abused by calling caste name and assaulted to the informant and others. Six persons received injuries and the injuries of three have been found grievous. It is submitted by learned counsel for the petitioners that the land in question belongs to the petitioners and has been recorded in the revenue record in the name of the petitioners. The specific accusation of assault is only against Bangtu singh and Braj Bhushan Singh.
Considering the aforesaid facts, let the learned court below consider the prayer for regular bail of the petitioners, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Kusheshwar Asthan P.S. case No.309 of 2015, pending in the court of learned S.D.J.M., Biraul, Darbhanga.
With the above observation, this application is disposed of.
