JUSTICE SANJAY PRIYA ORAL ORDER 09-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Jakkanpur P.S. Case No. 16 of 2017, G.R. No. 428 of 2017 instituted for the offence under Section 414 of the Indian Penal Code.

It has been submitted that name of this petitioner has been disclosed by apprehended co-accused Ritik Kumar and Nikhil Raj with motorcycle which is alleged to be stolen one. He disclosed the name of other accused persons including this petitioner.

It is alleged in the written report that on disclosure of the apprehended persons, the police recovered one Scooty in front of the house of this petitioner. Similar statement has been made in the seizure list that the Scooty has been recovered in

Patna High Court Cr.Misc. No.21195 of 2017 (2) dt.09-05-2017 2/2 front of the house of the petitioner. As such, recovery has not been made from conscious possession of the petitioner. It is mentioned in paragraph-3 of the bail petition that petitioner has clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Jakkanpur P.S. Case No. 16 of 2017, G.R. Case No. 428 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
