The petitioner apprehends his arrest in Mokama P.S. Case No. 118 of 2018, registered for the offences punishable under Sections 304/34 of the Indian Penal Code. As per the prosecution case due to negligence of the accused persons, sister-in-law (Gotni) of the informant died. It is submitted that petitioner is neither owner nor doctor of the said Shivam Clinic, Mokama where the deceased was admitted. Petitioner is working as Compounder in the said hospital. Operation was conducted by Doctor Sunil Kumar Singh and due to anemic the sister-in-law of the informant died on the way while being taken to Patna for better treatment. Petitioner claims clean antecedent.

No.14892 of 2022(2) dt.23-08-2022 2/2 Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Barh, Patna in connection with Mokama P.S. Case No. 118 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
