This is the second attempt on behalf of the petitioner for grant of bail in connection with Gogari P.S. Case No.227 of 2023 registered for the offence under sections 341, 323, 324, 307 & 504/34 of the Indian Penal Code. Earlier, the prayer of the petitioner for grant of bail has been rejected by this Court vide order dated 16.04.2024 passed in Criminal Miscellaneous No.7689 of 2024.

The petitioner is said to have assaulted the deceased with iron Baithi ( a weapon used for cutting fish). The deceased died after a month while under treatment in AIIMS, Patna.

The petitioner is in custody since 27.06.2023 having clean antecedent.

Considering the period of custody of the petitioner and also the delay in trial, this bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria / concerned Court below, in connection with Gogari P.S. Case No.227 of 2023, subject to the condition that he will cooperate in the trial and will appear himself or through his lawyer on each and every date fixed in the trial.
