JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2015 Heard learned counsels for the petitioners and the State. The petitioners being the parents of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 341, 342, 498A, 324, 326, 307, 304B and 120B of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The accusation is of causing burnt injury to the daughter of the informant for non-fulfilment of the dowry demand who subsequently died.
It is submitted by learned counsel for the petitioners that the victim received accidental burnt injury on 05.03.2014 and she was being treated at the behest of the husband of the victim, ultimately she was reached to her parents' house on 17.03.2014,
Patna High Court Cr.Misc. No.5568 of 2015 (2) dt.11-02-2015 2/2 thereafter, the FIR was registered under Section 307 IPC on 29.03.2014 and subsequently the victim died on 05.04.2014 at the informant's house. It is further submitted that the victim's statement has never been recorded and the informant has admitted that the victim was reached to informant's house on 17.03.2014. Considering the delayed lodging of the FIR and the victim subsequently died at the informant's house, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri, Rohtas in connection with Mahila P.S. Case No. 07 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
