JUSTICE RAKESH KUMAR ORAL ORDER 24-02-2016 Heard Sri Aditya Nath, learned counsel, who was assisted by Mr. Md. Ataul Haque, learned counsel for the petitioner and Sri Tapeshwar Sharma, learned A.P.P. The sole petitioner, apprehending his arrest in connection with Begusarai Town P.S. Case No. 188 of 2015 registered for the offence under Section 341, 342, 324, 326, 307, 379 and 34 of the Indian Penal Code has prayed for grant of anticipatory bail.

It was submitted by learned counsel for the petitioner that petitioner is brother of the wife of the informant. Prior to lodging of this case a case was instituted by the wife of the informant regarding offence under Section 498(A) of the I.P.C. and during the pendency of the said case some amicable

Patna High Court Cr.Misc. No.5849 of 2016 (2) dt.24-02-2016 2/2 settlement had taken place. However, subsequently with a view to put pressure on the prosecution case the informant has fabricated a false case and implicated the petitioner, his father as well as his sister also.

Besides hearing, I have also perused the materials available on record.

In view of the facts and circumstances, in the event of arrest or surrender within a period of six weeks from today, let the petitioner Deepak Kumar @ Deepak Kumar Ram be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S. Case No. 188 of 2015 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure.
