The petitioner is apprehending his arrest in connection with Amour P.S.Case NO.163 of 2018 , registered for offences punishable under Sections 466, 467, 468, 474, 471, 420/34 of the Indian Penal Code.
FIR has been lodged by the Circle Officer, Amour Circle Office with allegation that on the basis of Bandobasti Parwana No.11/95-96, the petitioner moved for measurement of land of Khata No.541 before the Public Grievance Redressal Officer, Baisi but later on found that Bandobasti No.11/95-96 is registered in the name of Bacha Lal Harijan and the said land is in Basgit Purcha Register No.27/94-95/11/95-96 in the name of Harun. Revenue Karamchari has also submitted that Parwana and Legal notice submitted by the application are different and the said Parwana is forged and illegal.
Submission of the learned counsel for the petitioner is that he has only applied for measurement and without any
Patna High Court CR. MISC. No.12985 of 2019(4) dt.10-05-2019 2/2 proper inquiry he has been made accused in this case. He is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Amour P.S.Case No.163 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will appear before the Investigating Officer as and when required and shall co-operate in the investigation.
With the aforesaid direction, this application is allowed.
