2. The petitioners have preferred this application for grant of regular bail in connection with Durgawati P.S. Case No. 380/2024 dated 07.12.2024 registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(2), 117(2), 125, 109, 132, 121(1), 121(2), 324(4) of the B.N.S. and Section 27 of the Arms Act.

As per the prosecution case, the petitioners along with 40-50 unknown persons holding pistol, lathi, danda and hockey stick in their hands are alleged to have damaged the police jeep and they also assaulted the informant and police personnel causing injury. It is further alleged that the accused persons caused hindrance in discharge the official duty of the police personnel.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have no concern with the alleged occurrence. Local persons disclosed the name of the accused persons including the petitioners. There is general and omnibus allegation against the petitioners. The petitioners have one antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 10.12.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Mohania, Kaimur (Bhabhua), in connection with Durgawati P.S. Case No. 380/2024.

7. The application stands allowed.
