JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The petitioner seeks regular bail in connection with Barauni P.S. Case No. 20 of 2017, registered for offences punishable under Section 188, 30(a), Bihar Excise Amendment Act, 2016.

It has been submitted on behalf of the petitioner that thought there is allegation of recovery of 8.20 of indian made foreign liquor from the possession of the petitioner, however he has clean antecedent and has been in custody for more than one month.

Heard learned A.P.P. also.

Having heard both sides, in view of the fact that in this case there is only recovery of 8.20 litres of foreign liquor and the petitioner has clean antecedent and has remained in custody for

Patna High Court Cr.Misc. No.10448 of 2017 (2) dt.06-03-2017 2/2 about one and half months, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Barauni P.S. Case No. 20 of 2017. It is also made clear that if the petitioner again found involved in any of such offence, in future, prosecution will be free to move for cancellation of his bail bonds.
