The petitioner seeks bail in connection with Laukahi P.S. Case No. 118 of 2018, registered under Sections 147, 148, 149, 323, 324, 307 and 504 of the Indian Penal Code.

The accusation is that informant Naresh Rai and his cousin Raj Bandhu Prabhakar were present at Bhutaha Chowk as Raj Bandhu Prabhakar had to go to the house of his sister. At that time, due to land dispute, nine persons named in the F.I.R., including the petitioner, surrounded Raj Bandhu Prabhakar and started to abuse and caused assault to him. On hulla, informant and Chintu Singh reached there then saw that Lambodar gave iron rod blow at the left hand of Raj Bandhu

Patna High Court CR. MISC. No.9410 of 2020(2) dt.24-02-2020 2/2 Prabhakar, when he and Chintu Singh tried to save Raj Bandhu Prabhakar then all attacked on them. At that time, Ashok Singh caused injury on his head through iron rod and Yugeshwar Ray (petitioner) also started to cause assault to Chintu Singh and caused injury to him.

Learned counsel for the petitioner submits that specific allegation against the petitioner to cause injury to Chintu Singh, out of three injuries, as found on the person of Chintu Singh only one injury found on the head is grievous in nature. The petitioner is in custody since 11.12.2019. The Police, on investigation, has already submitted Chargesheet. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate, Jhanjharpur (Madhubani) in connection with Laukahi P.S. Case No. 118 of 2018.
