Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Excise Case No. 268 of 2020 registered for the offences punishable under Sections 30(a), 41(i) of the Bihar Prohibition and Excise Act.

On search, 2458.80 liters foreign made liquor was recovered from Old Home Guard Office. After seeing police personnel four accused person fled away from the spot. It is submitted that petitioner has no concerned with the said liquor and he has clean antecedent. Nothing

Patna High Court CR. MISC. No.21862 of 2021(2) dt.03-01-2022 2/2 incriminating article has been recovered from conscious possession of the petitioner and he has apprehended from the spot. On similar footing co-accused Pankaj Kumar has been granted bail in Cr. Misc. No. 2773 of 2021 vide order dated 03.12.2020 by a co-ordinate bench of this Court. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioner in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Motihari, East Champaran in Excise Case No. 268 of 2020 subject to condition as laid down under Section 438(2) of the Cr.P.C.
