The petitioner apprehends arrest in a case registered for the offence punishable under sections 3,4,5,6 of the Immoral Traffic Act and section 8 of the POCSO Act.

As per the prosecution case, petitioner with the aid of other accused persons was running sex racket in the Hotel. Learned counsel appearing for the petitioner submits that petitioner's name has figured during course of investigation in confessional statement of co-accused. Petitioner is not the owner of the Hotel and he is no way concerned with the said Hotel. Petitioner claims clean antecedent.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender

Patna High Court CR. MISC. No.12424 of 2023(2) dt.28-04-2023 2/2 within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VII cum Special Judge, POCSO Act Motihari, East Champaran in Mehsi Police Station Case No. 247 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
