Petitioner is accused in connection with Kotwa P.S. Case No. 51 of 2016 registered under Sections 272, 273 of the I.P.C. and sections 47(a), 53(c), 54 of the Bihar Excise Amendment Act, 2016.

Learned counsel for the petitioner submits that petitioner has been implicated in this case on suspicion. Nothing has been recovered from the conscious possession of the petitioner. Recovery has been made from a place behind the shop of the petitioner. It is submitted that petitioner has no criminal antecedent and is in custody since 18.12.2016.
